Restricted Site Terms of Use as at February 2009

  1. General
    • These Terms of Use (‘Terms’) govern all use of travel4press.co.uk (the ‘Site’).
    • The Site is owned and operated by us, Adfero Ltd, of Fifth Floor, South Quay Plaza, 183 Marsh Wall, London E14 9SH, tel 020-7517-2200, email info@travel4press.co.uk, VAT number 752-2449-35.
    • Use of the Site beyond that expressly permitted by these Terms, is unauthorised and unlawful.
    • We have the right to modify these Terms at any time.
  2. Access
    • We as the owner of the Site have the right to decide to whom we are willing to grant access to it, and on what terms. We may grant or withdraw rights to access at any time, at our sole discretion, and without being required to give reasons.
    • There is no charge for access to the Site; however, access is restricted to those Qualified Users to whom we have expressly granted permission and issued a user name and password. To be a Qualified User you as an individual must be either a bona fide journalist (whether employed or freelance), or a professional working in the field of Public Relations (whether employed, or independently). Any permission granted to you to access the Site is conditional on you continuing to be a Qualified User, and, if you cease to be a Qualified User you must cease to access the Site, and must advise us accordingly.
    • The right to access and use the Site is personal to each User permitted access by us, and may not be assigned or further delegated. Use of the Site by any other person, and use by any person beyond that expressly permitted by these Terms, is unauthorised and unlawful.
    • Access to the Site is by password; you are responsible for the security of any password allocated to you. You are wholly responsible for all use of the Site on your account when accessed by your password, and any use of the Site when accessed by your password is conclusively deemed to be authorised by you.
    • You may not access or use the Site for purposes in connection with or for the promotion of any service competing with the Site.
    • So far as is practicable the Site is available on a 24 hour 7 day basis; it is however technically impossible to guarantee fault-free availability, and the Site is provided ‘as is’ and ‘as available’; whilst we will use reasonable efforts to minimise unavoidable interruptions, there will inevitably be times when the Site is unavailable.
  3. Content
    • Any information and analysis on the Site or included in any email alert from us (‘Material’) is made available ‘as is’ and ‘as available’. Any Material is made available in good faith by us, and whilst we will use reasonable endeavours to ensure the accuracy of Material originated by us, we make no warranties (express or implied) regarding accuracy or completeness or fitness for any purpose, and we expressly exclude any liability in respect thereof (other than warranties not capable of exclusion). In particular, we accept no responsibility for Material not originated by us (other than warranties not capable of exclusion).
    • The information in Material may be updated from time to time, and may become out of date. We accept no responsibility for keeping the Material up to date, and no liability for any failure to do so. No liability is accepted for any errors, or for any losses that may be incurred if any Material is relied on.
    • Material is intended for general reference only. Application of Material to any specific instance or for any particular purpose is a User’s sole responsibility, and it is a User’s responsibility to satisfy himself as to the accuracy of Material by such other enquiries as he thinks fit before placing reliance on it.
  4. Interllectual Property Rights
    • The copyright and database right in Material remain the property of Adfero Ltd or of the copyright owners (as the case may be). Under no circumstances will you have any claim to copyright or ownership of any intellectual property rights in any Material. Except as expressly permitted by these Terms, no Material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without our prior express written permission.
    • All such rights as we grant you to use Material are limited to use for information gathering and reference in connection with your occupation as a Qualified User. You may permit your computer to make an electronically stored, transient copy of Material from the Site for the purpose of viewing it while connected to the Internet only. You may save one electronic copy of any Material for your own reference purposes only.
    • You may not distribute, display or copy any Material (in electronic or other form) to third parties, including (but not limited to) 'caching' any material from the Site for access by third parties, and 'mirroring' Material on any other site.
    • Your rights to reproduce Material for publication are limited to those rights generally known as ‘fair dealing’, as set out in s30 of the Copyright Designs and Patents Act 1988.
    • Unless otherwise specified, each author of Material on the Site has asserted his/her moral right pursuant to Section 77 of the Copyright Designs and Patents Act 1988 to be identified as the author thereof.
  5. External Links
    • Certain sections of the Site contain links to external web sites maintained and operated by third parties. These links are provided solely for the convenience of Users, and the provision of such links does not imply any endorsement of or affiliation with such website. We are not responsible for (or for the accuracy of) any information on any such third party’s website.
    • You must remove and not reinstate any link to this website from any other website if we request you to do so. You may not create any link to or use this Site (or any portion thereof) in any manner which may circumvent our restrictions on access to the Site, or which may create a likelihood of confusion about the identity of this Site, or as to sponsorship of third party content by us, or as to an affiliation with this Site or with us.
  6. Liability
    • You must ensure that your use of the Site and of any Material is in no way unlawful, that such use does not infringe our rights or those of the owner thereof, and you will fully indemnify us against any liability we may incur as a result of any use by you which is unlawful, infringing, or which is in breach of these terms.
    • We shall not be liable to you for any loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with the Site, or from any misrepresentation, whether innocent or negligent, except to the extent that such liability may not be lawfully excluded.
    • In no event will we be liable for indirect, special, incidental or consequential loss or damage which may arise in respect of the Site, its use, or in respect of other equipment or property, or for loss of profit, business, revenue, goodwill or anticipated savings, even if we have been advised of the possibility of such loss.
    • In the event that any exclusion or other provision contained in these Terms be held to be invalid for any reason and we become liable for loss or damage that could otherwise have been limited, such liability shall be limited to ₤100.
    • We do not exclude liability for death or personal injury to the extent only that the same arises as a result of negligence for which we are liable.
  7. Miscellaneous
    • By using the Site you agree to be bound by these terms. These terms supersede all prior agreements and (together with the Privacy Policy) are complete and exclusive. No oral or written information given by us or on our behalf shall create a warranty or collateral contract, or in any way increase the scope of our liability, and you may not rely on any such information. Except as otherwise provided, no addition, amendment or modification of these Terms shall be effective, unless in writing and signed or accepted by us.
    • This Site is aimed at users in the United Kingdom. Where UK regulatory authorities have jurisdiction over the contents of this Site, we have attempted to ensure compliance with the requirements of such regulatory body. However, some of the information in the pages contained in this Site is not intended for access from certain other jurisdictions, and no representation or warranty is made as to whether the information available in this Site complies with the regulatory regimes of jurisdictions other than those within the United Kingdom.
    • These Terms and all use of the Site are governed by the laws of England and any questions arising shall be dealt with only by the English courts.
